Copyright and DMCA
KARD respects the rights of copyright owners and expects members to do the same. If you believe something on KARD infringes your copyright, you can send us a notice. We respond to notices that meet the requirements of the Digital Millennium Copyright Act (17 U.S.C. § 512). Reports about trademarks or counterfeit cards go through the report button, as described in the Community Guidelines.
Send a copyright notice
Your notice must identify the copyrighted work, identify the material on KARD that you say infringes it so we can find it, and include your contact details, the statements below, and your signature.
Be aware that a notice is a legal statement. Knowingly making a false claim can make you liable for damages. If you are not sure whether something infringes, you may want to talk to a lawyer first.
What happens next
- We review the notice. If it is complete and the material appears to infringe, we remove or disable access to it and tell the member who posted it.
- We keep a record of notices, and we close the accounts of members who repeatedly infringe.
- We may share a copy of the notice, including your contact details, with the member who posted the material.
Counter-notice
If your content was removed and you believe that was a mistake or that you have the right to use the material, you can send a counter-notice through the contact form. It must include:
- Your physical or electronic signature.
- What was removed and where it appeared before it was removed.
- A statement, under penalty of perjury, that you have a good-faith belief it was removed by mistake or misidentification.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal court for your address (or, if you are outside the United States, any court where KARD can be found), and that you will accept service of process from the person who sent the original notice.
We pass the counter-notice to the person who sent the original notice. Unless they tell us within 10 business days that they have started a court action, we may restore the material in 10 to 14 business days.
